1. The Service

Poker Ascent is a poker training application. It is not a gambling service, there is no real-money poker, betting, or wagering of any kind. Poker Ascent is purely educational.

2. Eligibility

  • You must be 18 years or older to use Poker Ascent
  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account

3. Accounts

  • One account per person
  • You are responsible for all activity under your account
  • You may delete your account at any time
  • We may suspend or terminate accounts that violate these terms

4. Subscription Plans and Payment

4.1 Free Plan

Includes daily drill quota, beginner and intermediate tiers, streaks, XP, and basic progress tracking.

4.2 Premium Plan

Includes unlimited drills, all tiers, full progress tracking, premium power-ups, and all future features.

4.3 Billing

  • Web payments processed via Stripe (auto-renewal monthly or annually)
  • In-app purchases via Apple or Google (their respective terms apply)
  • Prices displayed in your local currency
  • We may change pricing with 30 days notice

4.4 Cancellation

  • Cancel anytime
  • Access continues until the end of your current billing period
  • No partial refunds
  • Your account reverts to the free plan after cancellation

5. Educational Content Disclaimer

Poker Ascent provides strategy education based on widely accepted poker principles. Our content does not guarantee winning results. Please understand:

  • Correct answers may vary depending on game conditions
  • Poker has inherent variance: results will fluctuate
  • Multiple valid strategic approaches often exist
  • We are not responsible for financial losses from real-money poker
  • Past drill performance does not predict real-world results

6. User Data and Content

6.1 Your Data

You grant us a worldwide, non-exclusive, royalty-free license to use your gameplay data in anonymized, aggregated form for improving content, conducting research, creating anonymized datasets, and publishing insights. This license does not include identifying you personally.

6.2 Data Usage Rights

  • You retain ownership of your personal account information
  • Anonymized, aggregated gameplay data may be used commercially

7. Acceptable Use

You agree not to:

  • Reverse-engineer or decompile the application
  • Scrape data or use automated bots
  • Share your account with others
  • Manipulate gameplay data or progress
  • Redistribute our content without permission
  • Use the service for any illegal purpose
  • Disrupt or interfere with the service

8. Intellectual Property

  • All content, drills, and materials are owned by Poker Ascent
  • The Poker Ascent name and logo are trademarks
  • No reproduction or distribution without written permission
  • Personal screenshots of your own progress are permitted

9. Termination

  • You may delete your account at any time
  • We may suspend or terminate accounts for violations of these terms
  • Your rights to use the service cease immediately upon termination
  • Provisions that should survive termination (liability, IP, disputes) remain in effect

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, poker success, or immediate error correction.

11. Limitation of Liability

Poker Ascent is not liable for indirect, incidental, or consequential damages, including lost profits, poker losses, or any damages exceeding the total amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Poker Ascent harmless from any claims, damages, or expenses arising from your use of the Service, violations of these terms, or infringement of third-party rights.

13. Dispute Resolution

  • Disputes resolved through binding arbitration under AAA rules
  • Arbitration on an individual basis only: no class actions
  • Governed by the laws of the United States

14. Changes to These Terms

We will notify you of changes via in-app notice and by updating the date at the top of this page. Continued use of the Service after changes constitutes acceptance of the new terms.

15. General

  • If any provision is found unenforceable, the remaining provisions remain in effect
  • Our failure to enforce a right does not constitute a waiver
  • These terms constitute the entire agreement between you and Poker Ascent
  • You may not assign your rights without our consent
